Site slandering my site
I have a site that is full of a bunch of people that got banned for spamming and other things from another site. IT just happens that they went public about the same time as me and since have been blaming my site for anything and everything that has happened to them. What should I do to get this handled. I contacted there host today, but no phone number and no response yet. Any suggestions... someone told me a cease and desist notice may be in order.

If its seriosuly damaging you, sue or send a cease and dissist, otherwise ignore it.

I agree with Zachery. Even if it's not seriously damaging you, you should still get an attorny or something and send them a formal letter giving them warning before you take legal actions or sue them. Usually some just back off by getting a formal letter first, if they did not respond to that, then take legal actions. Also double check the dates or the time that your site and their site was released. If you could prove that your site was up before theirs, and that you could prove enough damages from them, then you could without a doubt cease and dissist, however, it would still be a little hard for you to do that if they haven't copied anything from you.

I'm affraid that sending a legal notice is only going to enthrall them. It sounds like your dealing with a pack of morons. To have a lawyer write up a complaint is going to cost a pretty penny. Taking further action is going to require even more pretty pennys. If it was me, I'd simply ignore the slander and move on, given they are not damaging site property or income.

Generally speaking, it's a waste of your time, effort, and money getting a lawyer to write something up so you can threaten to sue someone unless you seriously intend to do it -- for real. Keep in mind, too... that unless you can produce tangible/objective evidence of damage you've incurred (as in money), then there's no case to be filed against them.

The best way to deal with annoying internet morons is just to ignore them until they tire of it and move on to something else, amigo.

They are not slandering you, slander is spoken word, printed word is libel.

when I mentioned taking legal action or sending letter, I meant only if they are seriously damaging your site as mentioned. By damage assuming financial damage mainly.

What you could do is try to either get a hold of a template or get some of your mates together and write up a formal SOUNDING letter. Use lots of old fashioned English like "preshruming" (no idea how its spelt XD).
This is of course assuming their IQ is that of fried shit. If not then do what the others said, as Im not going to encourage you into talking to some hackers... XD |
