Allow Certain user Groups Ability To Use Banned E-mail

I want to allow certain user groups to be able to use e-mails that are listed in the banned e-mail list.

I have this hardcoded now but upgrading I cannot find the validation to hardcode it again.

Could this be a plugin? If so what type of plugin and what would the code be?

Anyone? I can't even find the validation for it anymore in the code. 3.5 code is a lot tougher to follow.
