if you have a webhost that gives you cpanel. go to the server loads function periodically and take a snapshot of what the server loads are and note them throughout the day. the best way to do this is to open up some sort of graphics editor, go to the page with the server loads and click "shift + print screen". then go to your graphics editor and "paste". crop the entire page down to that server load area and i'd note the time and date on that screen capture.
i know this sounds tedious, but it is good evidence and then you should email it to your webhost's support. hopefully, they will move you to a better box.
i've had several incidences and once shared a box with an abusive client which was using their site as a download mirror. that just killed the box. luckily, they were suspended soon thereafter.
