I didnt get to read the whole article but the impression I was left with when I first read it was they planned to go after people acting as supernodes on services such as shareaza or kazaa -- these people aren't techinically DL'ing the stuff, tis just going through them much like the isp.

All they need is the information off the ISP's. Once they have the power to force ISP's to give up the information, it'll all be over.

My ISP is mainstream, and last time I read a little into it they refused to give names of their users who, the british-equivalent of the RIAA, found to be sharers of large quantities of music on P2P networks. I don't know if the situation is much different in the US

Hmm.. yes, I see what you mean. But I wasn't meaning the RIAA. Sounds like Ashcroft is talking about the Department of Justice and the FBI, which isn't quite the same.
