Anyone knowledgeable with copyright here?
Or atleast I think copyright is relevant in this situation.
An aspect of my forum is people can share their personal stories which is made into a resource. The resource won't be sold on or used to make a profit in any way. However I'm sure we should be getting people to agree to ToS or copyright that gives us partial "ownership" of the document? As in, we're a non-profit so won't be doing anything devious with the content, BUT, content and forum posts are basically our only asset so we need to protect it. What would you do? Is it even necessary |

Sounds lke you should seek legal advice. It seems to be different by country, and a lot of people (like me) think they know a little bit about it, so when you ask on a forum like this you tend to get a lot of different answers.

It does depend on what country you're hosted in.

You need a TOS to state WHAT you do with the content.
Also, look at the copyright laws in the country the server is hosted in. Since those laws will apply to the data on the server. That's one reason why piracy is huge, because some countries have no copyright laws. So the servers their can host illegal copyrighted material and go unpunished. But in other countries like USA, they would have to go through a huge lawsuit. |

Hmmm, thanks for the replies. We're located in New Zealand and so are our servers so I'll have to try find someone with law knowledge to help us out (and hopefully within our financial means). For now a ToS statement will have to do.

The copyright law of New Zealand is covered by the Copyright Act 1994 and subsequent amendments.[1] It is administered by Intellectual Property Policy Unit of the Ministry of Business, Innovation and Employment (MBIE).
New Zealand is party to several international copyright agreements, including the TRIPS Agreement 1994, the Berne Convention 1928 and the Universal Copyright Convention 1952. http://en.wikipedia.org/wiki/Copyrig...of_New_Zealand |
