It is supposed to be. Microsoft just lost a lawsuit because a Canadian company has a patent on using custom XML for document structure and collaboration as well as transferring information between computers. That is actually the entire purpose between the XML specification.
This means that any application that uses XML is at risk. Of course XML is also the basis of the majority of AJAX and interaction that happens on the web these days. Even RSS is a customized form of XML.
