OK - I got what I perceive as a most short and ugly message from vB.org Administrator davidw.... Now - I take a few moments out of my day (just being generous I thought) to upload a couple avatar packs: Glamour Avatars & Artistic Avatars - both of which contain images that can freely be attained from the internet on most all avatar websites...

I've just had vB Coordinator Marco post a very simple message in my Artistic Avatars thread: Is this your original work? --- nothing more just that one brief sentence as if it's a prequel to ugh....

I comment:
WhY? Are you gonna continue to go around deleting my damn threads?
No it is not my original work - but I would say each of the images in those packs are readily available on the internet - I would think they're not subject to any copyright. The Glamour avatar thread I posted earlier (just being generous and wanting to share) is not subject to any copyright either. It got deleted and none of you vB.org Admins even gave notice = THAT SUCKS!

I would think that you'd be more amiable to Members who are taking time out of their lives to be as generous as to share a pack of avatars.

That's it - just wanted to post my opinion on this matter. I've been a Member of vB.org for over 1 year now - and have never until this time posted/shared neither my template modifications, nor any of my graphic creations.

If this is the way vB.org feels fit to treat people who out of the generosity of their souls, shares something they think other Members can generally benefit from - I say it's the last time I share

Posting copyrighted material is against the rules - it goes against copyright laws and it would be a very big insult to users who posted their copyrighted work here if we did not follow comply to these rules.

It's not a personal attack on you. We appreciate your participation here, we just can not have copyrighted work posted here without the author's specific permission.

I believe there is a law that basically says anything u post on your website or whatever is copyrighted. That means whereever those came from is copyrighted in the first place.

Anything you produce is instantly copyrighted by you. This applies to the United States. You do not have to file any paper work. It is automatic.

I dare say then most of the avatar threads, smilies threads (accept for the brilliant work of SHELLEY) and a lot of the other threads specifically within the graphics section would be deleted then - My general understanding of graphics works in particular - is that if there is now copyright text and/or ownership stated point blankly and without any misunderstanding - then the graphics are in a public domain and readily available for anyone who wants to use them.

Now - understand that we're not talking about the AOL, vBulletin and/or similar big company logos - we're talking about a package of images used as avatars on forums. For instance - the Artistic Avatars post I made is made of DaVinci works, as well as from a selection of works Dega, Cezanne an other known artists of the 17th, 18th, 19th & 20th centuries. Are YAWL saying such avatar images are copyrighted?

That's ludicrous - And please let's not stretch the issue farther than what it is.

Yes. I am not a lawyer, so please don't take this as legal acumen but the Copyright Act of 1976 along with the Digital Millennium Copyright Act work together to state that any work digitally represented is copyrighted to the owner. In the case of iconator (by looking at their T.O.S) they assume that the one who uploads the work is the owner of the material.

Just because they upload their work to iconator does not mean they give consent for other to upload elsewhere. The same goes for modifications posted here. We are required by law to respect copyright so we have this clause in our general rules:

Jacquii, i'm with the admins on this one I'm afraid. Provide proof that you have permission to distribute the avatars from the original author and you won't have a problem

The relevant part is highlighted. To release work here you should either be the author, or have the authors permission (which we may ask for proof of).
