Site slandering my site

I have a site that is full of a bunch of people that got banned for spamming and other things from another site. IT just happens that they went public about the same time as me and since have been blaming my site for anything and everything that has happened to them. What should I do to get this handled. I contacted there host today, but no phone number and no response yet. Any suggestions... someone told me a cease and desist notice may be in order.

Zachery 07-01-2006 03:13 AM

If its seriosuly damaging you, sue or send a cease and dissist, otherwise ignore it.

Sean S 07-01-2006 03:56 AM

I agree with Zachery. Even if it's not seriously damaging you, you should still get an attorny or something and send them a formal letter giving them warning before you take legal actions or sue them. Usually some just back off by getting a formal letter first, if they did not respond to that, then take legal actions. Also double check the dates or the time that your site and their site was released. If you could prove that your site was up before theirs, and that you could prove enough damages from them, then you could without a doubt cease and dissist, however, it would still be a little hard for you to do that if they haven't copied anything from you.

Good luck to you.

I'm affraid that sending a legal notice is only going to enthrall them. It sounds like your dealing with a pack of morons. To have a lawyer write up a complaint is going to cost a pretty penny. Taking further action is going to require even more pretty pennys. If it was me, I'd simply ignore the slander and move on, given they are not damaging site property or income.

Generally speaking, it's a waste of your time, effort, and money getting a lawyer to write something up so you can threaten to sue someone unless you seriously intend to do it -- for real. Keep in mind, too... that unless you can produce tangible/objective evidence of damage you've incurred (as in money), then there's no case to be filed against them.

The best way to deal with annoying internet morons is just to ignore them until they tire of it and move on to something else, amigo.

FleaBag 07-01-2006 03:58 PM

They are not slandering you, slander is spoken word, printed word is libel.

Sean S 07-01-2006 05:01 PM

when I mentioned taking legal action or sending letter, I meant only if they are seriously damaging your site as mentioned. By damage assuming financial damage mainly.

Revan 07-01-2006 10:43 PM

What you could do is try to either get a hold of a template or get some of your mates together and write up a formal SOUNDING letter. Use lots of old fashioned English like "preshruming" (no idea how its spelt XD).
This is of course assuming their IQ is that of fried shit.

If not then do what the others said, as Im not going to encourage you into talking to some hackers... XD

You could look/ask at the forum at piratereports.com, you might find some legal tips there.

Dear x,
As the legal owner of x we are writting to you with a formal notice as assumed responsible party for the content on the former mentioned website. Our clients (your name, of your website) have found unfounded claims on your website. Details of these claims are attached on another page in detail. Obviously if this continues it becomes a legal matter as it is causing considerable damage to our (whatever its damaging, reputation, profits or whatever). If you are not able to control the content being published on your website we suggest you shut it down, as this is the only warning we will send before we ask our legal representatives to take further action against you. You may contact me, but not (your name) at any time to discuss this matter further.

Regards
("lawyers name")

include details of each 'claim' that was made, by who, what time, which page etc. dont try and justify yourself as in 'which is obviously not true because everyone knows i hate dogs' just put what has been said in writing.

Im not a lawyer but if they continue then youve asked them to stop, made it clear what theyve done wrong, said that youre holding them responsible, if they dispute it thats fine, but if they just continue then they know theyve done something wrong, and then i think you have a case.

Good luck xx

Turn it into a positive. After all, it is free advertisement. :)

PennylessZ28 07-05-2006 12:34 AM

Been there done that.

Calisse 07-05-2006 04:57 AM

Then why didnt you try posting something useful to the conversation?

Finally something I can contribute to. I was slandered on a board once and they posted my IP number of my computer publicly for all to see. Don’t know how serious that is some say it isn’t and other say it is. However I retained a lawyer and he sent letters to the site admin and the not sure of the terminology but the host and server? Anyways after thousands of dollars for his research of the laws he said to go further would cost me at least 20 thousand to take them to court. He was quite sure we had a good chance of winning. So I dropped it as I didn’t have that kind of money to do that.

Mark.B 07-09-2006 07:14 PM

I've had all this too. If I had threatened the perpetrators with some sort of legal action, it would have absolutely made their day.

So I took to compltely ignoring everything and anything they did.

After a period of depserate attempts to get me to go and post on their site, they gave up and vanished.

It's the old 'bully' scenario....don't respond. They hate that.

kobescoresagain 07-10-2006 11:45 PM

Update, I contacted the host of this site, I noticed that they have been taken down.

zooki 07-11-2006 12:02 AM

Ok kool their site is down :)

25% of my hits come from people talking negatively about my website...... Is it such a bad thing?? depends on the site....

Also, Perhaps one needs to look into how popular that other site is too. check on alexa.com.... if it doesnt show up, not much use worrying about them. They are small fish.
