Who can I complain too?

Hello

In March I bought a skin off someone on here who custom designed it for me only to find he has resold it on the Sitepoint forums and has lied and said I vanished without paying for it even tho that is not true and I have proof.

Who do I cntact about this so I can PM them with the info?

Thanks

Marco van Herwaarden 06-22-2006 12:14 PM

I am really sorry if you feel an agreement with someone wasn't fullfilled to your expectations. However this was an agreement between you and this person. Neither vBulletin.org or Jelsoft is a party in this transaction, so there is not much we can do to help you.

Depending on how the transaction and the agreement was made, and the locations of both you and the other party, you might however have some ways to dispute the transaction. If you provide a bit more information, another member might be able to give you advice on how to handle this.

Moving this to The Lounge.

I thought vbulletin.org might be interested as they have a fraud on there forum who sells stuff and then resells them even tho he shouldnt, thought you might not want that kind of person on here?

I have all the proof too, pm proof, email proof, paypal proof.

I bought the skin off him for $160 (As I said I have the proof) and then he resold it on sitepoint claiming the original buyer (me) had 'vanished' when it is clearly a lie.

Marco van Herwaarden 06-22-2006 12:45 PM

I am really sorry for you, but we are not judges. We have no means to check your claim or your proof and make a judgement. I really wish we could do more, but that is impossible.

06-22-2006 12:48 PM

Okay, but if I was a forum owner I wouldnt want a fraud on the forum that rips people off, thats why I put it in the other forum first as thought you might be more interested in the user and maybe banning him.

But maybe wait until someone else finds out they have been ripped off first.

And you do have means to check my claim, I have proof.

I have the proof I paid for it
I have the proof he recieved the payment
I have the proof he sent me the files
I have the sitepoint topic where he tries to resell it.

Ill give you access to see for yourself if screenshots isnt good enough.

I cant believe even tho I have the proof the guy is still gonna be let allowed to do business on here and no doubt rip others off as well.

smacklan 06-22-2006 01:19 PM

It sucks to get ripped off, but this site isn't immune to those type of people doing business here. The best thing to do is seek references, get a written agreement and never pay full price until everything is delivered as promised. The org can't go around slandering and banning everyone who has a accusation arise against them...I'm sure you understand that. I hope things work out for you! Best of luck!

06-22-2006 01:23 PM

An accusation with solid proof tho....He sold me the template (I have the proof) and he tried to sell it on Sitepoint recently (The topic on there is proof), I am not sure what more is needed.

discusssport,

As said above, there isn't much you can do here since vB.org has no control over such matters.

If you haven't already then you may want to...

- Bring the issue to the attention of the SitePoint staff regarding the sale thread on their forums. Reselling a design that was previously sold as exclusive is a violation of their forums.

- If you are not going to use the design then report it to your credit card in an attempt to get your payment reversed.

- On which site did you get in contact with the designer? Report the problem to the administrators of that site.

Finally, if you don't mind.... could you PM me a link to the SitePoint thread? I do a lot of business with vBulletin designs from various people in the community and while I have a working 'Do not do business with...' list I would like to make sure that the person you're accusing isn't somebody that I'm doing business with as well.

vBulletin.org has a history of letting people who commit fraud continue to reside on their forums :) Legally, they are obliged to do nothing, so take more care when choosing your service providers next time!

On this forum, I posted a topic @ https://vborg.vbsupport.ru/showthread.php?t=109363 - Thats why I posted it here.

The guy then pm'ed me and everything went through PM, as I said I have the pm proof where I said I sent the money and he replied with 'sent', I have the email still when he sent me the files and also the Paypal transaction, I paid $160 for it.

As for the sitepoint topic, they have moved it right now, i am trying to get it back into viewable forum to show.

I will pm you his name tho.

Im not asking for them to 'legally' to do anything but I thought they might be interested that they have a fraudster on here and might care to make sure he doesnt rip people off again!

And what more care could I take? I came to this forum as I thought here would be the last place someone might be 'dodgy'.

Some forums here at vB.org are configured to not count to a person's postcount.

Why not post the persons screen name, and a warning, along with a link to the sitepoint for sale thread, the link to your forums using the custom theme, and anythign else that could help.

Hopefully next time people do a search and see it might be a little shady

I dont want to give the name out as I am sure the admins will just delete it.

The sitepoint sales thread got moved, I am working on getting it back to show you.

And my forums arent up yet, I havent had time to do it.

Just to explain it all once more.

- I posted a topic on here asking for a design
-The guy replied and on march 11th I sent payment (Which I have PM and Paypal proof)
- Browsing Sitepoint today I find that design is up for sale, he gave the reason for the sale as 'The old buyer (me) had 'vanished' indiciating I vanished and didnt pay for it and thats why he is selling it.

Now I have proof I paid for it, so why would he lie when selling it saying he was only selling it as I had 'vanished' when that isnt true and I have proof it isnt true?

I know the answer to that and I am sure you do as well.

Also he sold it for $20, what designer in there right mind would sell a custom made VB skin for just $20? Someone who has already sold it and is selling it again to get some extra money, thats who...

Discusssport,

Any chance it was a miscommunication that the icons & other graphics were to be customized for your site but that the base style wasn't necessarily unique?

06-22-2006 04:39 PM

Nope

But you know, Im done, nothing I can do it seems.

tgillespie 06-22-2006 05:35 PM

Being that this thread is about me, I guess I should make a post. First, an apology is due :surprised:

Everything DiscussSport says is true. He contracted me to design a template back in March which I completed. He was satisifed so I was paid in full. Everything went fine. The style was 100% unique even down to the icons as all of my work is. Just recently I was contacted by a member at vBulletin.org about doing a design for their site. Upon completion, the member stopped responding. No payments were exchanged. My mistake for not requiring a down payment. Anyway, I went to SitePoint to sell the PSD. Updating my portfolio with the template, I then proceeded to DiscussSport.com to check out how the skin was doing, only to find it at some forwarding page. DiscussSport had never installed vBulletin or used the skin to my knowledge, so I thought it was a dead project. This was a huge mistake and something I never should have done. I have never done it before, but felt bad that the skin was never going to be put to use. I felt wrong.

Anyway. I then went back to SitePoint and put the skin up for $20. I woke up today to find a PM from DiscussSport and a link to this thread. I immediately responded with an apology and asked DiscussSport if he wanted me to refund the customer on SitePoint and ask that the style be destroyed or I even asked DiscussSport if he wanted me to design a completely new skin free of charge. I apologize to DiscussSport and would like to make it clear that everything he says, is true, but I would also like to make it clear that this isn't something I do. I have many customers that would speak very well of me. I just happened to slip a few gears by reselling DiscussSport's skin, and for that, I am sorry.

Sincerely,
Trent Gillespie

Thank you for coming forward and have the courage to admit and applogize in public.

I guess we can close this thread now it is resolved.

bashy 06-22-2006 08:21 PM

Absolutely brilliant tgillespie, well done m8...
It takes a lot of courage to own up and apologise on an open forum...

I take my hat off to you my friend!!
