If the band is selling it somewhere and can make a profit off of it, it doesn't matter how *you* obtained it, it would be illegal for you to provide it to others for free.

Some have had their videos removed. Youtube gets take down notices and removes material all the time. But, some bands don't care - it's advertising for them. I was under the impression he wanted to try to do things as legally as possible. If so, then if I were him, I would not put officially released material up on a site.
