In a general forum such as vB.org, you will not be given a definite answer to legal questions. It somewhat oversteps the ethical and professional bounds. There are online legal services or as Wayne suggested to contact a lawyer (and in many cases the initial consultation is free).

I am in absolute agreement with Wayne Luke. You need to consult an attorney and not just for this instance.

There was a case not to long ago involving a girl on mys.....com who commited suicide and placed the information on her mys.... page. To make this even more horrorifying, there were "people" and I use that term very loosely, who encouraged her to do so.
