Server logs question
I would be grateful for some advice from one of the techs/legal members please.
If following a lawsuit for say defamation and slander of a member against a website, where the court grants access to the sever logs, who physically gets the logs to hand over. Is it the staff members of vbulletin or is it a tech from somewhere else? Does the member gain access to the server logs for the entire website or are just the logs in question sent to him? I would be grateful for information regarding this, thank you. |

It is definitely not a vbulletin staff member. Staff member's have no access to anyone's forums, court ordered or not.

I'd imagine it would be a court ordered person trained in forensics for computer systems.

Assuming the server in question is domestic (within the country you reside in), it would be an order of the court deliverable to the web hosting provider. And this assuming that all database is housed on that server. Of course you would also need to prove how the owner of the site / company was directly responsible. Going off at some random user would also require tracking down that user and this again assuming both the user and IP range is domestic. Internationally.... Things get interesting and a lot more involved. An outside country has no responsibility to comply with your local laws or government. Good luck though. |
