lasto, confirm your account and if the item still isn't shipped, then open a dispute with eBay. If you live in Texas you have the right to sue eBay if the item price is over $15.00 usd. eBay acts as a middle man and in Texas if the middle man doesn't hold there part of the deal, the you can take legal suite against them.
