TOS should include date/time (optional) and a disclaimer stipulating the above.
If you have a newsletter, I recommend a direct link to TOS.
As well as adding a link to all private messages (email and pm message).

Or install a modified version of amy's hack, that forces users to agree to the new TOS before they can post anything new
@T3MEDIA - Putting a disclaimer in your TOS about how you cannot be responsible for personal information exchanges should suffice in removing you from this equation - If you make it clear that if you divulge personal information publically that people may use it in a harming way, then you have done all you can to warn the user, and anything that happens to them, however tragic, cannot be blamed upon you...
