I think this host can be held responsible:
- Thug provided him with a valid vB source and asked to install
- Thug asked him to make some specific modifications
- Thug never ordered him to remove the backup possibility.

Like i see it, this host have made deliberate unauthorized changes to vB source.

We are not talking about bulletin software provided and owned by the host here. The software is owned by thug, and without explicit agreement this host can not make any changes to it, or change the functionality.

This woll not help much, but if brought to court, you could sue him for "breaking" something you own.
