I've been doing seo/sem for 15+ years, long before google and other companys came along. Our branding links all meet the required optimizations. If you read the guidelines it says not to have more than 100 links on your page, and that the quality of the links that are list are more important.

From this point forward I'd rather focus time, on supporting and building our scripts, than discussing if our copyright is going to hurt someones seo ranks, its not.

Sorry to say, but that is completly wrong, SEO is dependent on every small change on every Website, one Link more could at least get you one place lower for special keywords on every page, as Search Engines rank the importance of your Websites / of your Links by counting all the Links on your Website. Have a look at the Pagerank algorithm (I know PageRank is not very important for SEO). But as the rank decreases, it is a money-loss for many website owners. So that why it is not trivial, it is important.
Well, it seems like Backlink farming to me, you should offer a Link-free option with just text, like VBSEO does, then to come back to your point of fairness, it sounds "fair". I just wondered, you did SEO long before companies came along? What is the Point of Optimization then if there are no Search Engines?

And, do not trust Googles Guidelines completly, they do not give out much info.
