Help very much appreciated. Dispute Resolution

After agreeing a job with a developer and them not completing a job or giving refund. What is the best way to handle this?

I've used the resolution centre in PayPal. Is there anything else i could consider doing?

I am sorry to hear that bro but I do not think the resolution center is going to help you. That normally works with Ebay and shipped products.

They appear to be looking into it. They have a section for computer/software now :)

A lot will depend on where you and they are located. If you're both in the same country there may be more options open. In the USA there is "Small claims court" which doesn't require an attorney but it take quite a lot of time and paperwork.

What you cannot do is get this site involved- we do not take sides and we do not allow posting long complaints about someone else. If the issue was from the Paid Requests forum on this site you are allowed to post a short summary of the problem in the original thread only. Something like "So and so took this job but did not complete it and did not refund the money. Would not trust to use again."

Short and to the point.

i wish i had of created a thread in paid services now. i didn't know you were allowed to mention the usersname in that thread. i got ripped off $350 bucks from a VERY well known member of this site a few year back. his excuse for no refund was, he had a newborn baby at the time. well i have a 2 yearold, so wheres me money back lol. lately his started his own services back up again after changing domains etc, and he lurks these boards again. all conversations is still in me pm here. i wish mods could read my pm's and banned him. most mods and higher up here at vb org think this guy is an angle. when ever i do work for someone, i warn them about this guy, im guessing thats allowed?
anyways, it got me motivated to learn it all my self i guess. and started doing things for free for vbulletin users.

DreadsUK, sorry to hear about your problem mate. i couldn't do nothing about mine, because i couldn't prove it to paypal. so i made a ripoff report. maybe these days you mite actually get somewhere with paypal. a few year back you couldn't unless it was something you actually bought as a product or something from a server host etc.

good luck though man.

Even if we did read your PMs we still wouldn't ban anyone. Private transactions between customers are at your own risk.

This isn't you Shawney but I say this for the benefit of everyone reading because when someone does feel they have been cheated they are under the mistaken belief that if they could just prove it to us (staff) that the person who cheated them will be banned. They won't.

No matter how good you can make your case look it will always only be one side and we are not in a position nor do we have the desire to investigate these like the police would.

My advice is and always has been the customer should not pay anything upfront and shouldn't pay until they see a full working copy installed on the coder's test server. Once they are sure the modification/style is real and working only then should they pay.

If everyone followed this advice, few if any, would get scammed.

I realize some people have huge projects where this just isn't feasible as a coder isn't going to commit to hundreds or thousands of dollars of work without a confirmed payment- in these cases I can only suggest projects be broken up into smaller parts- $50, or $100 at a time.

As for most mods thinking someone is an angel- my list of "angels" on this site is exceptionally short.

As this is still currently in dispute, i feel to remain in honour i should first allow the individual time to change his tone and finish the job. If this is not done, i am more than happy to post it.

thanks mate. My law degree has kept me in good practise when it comes to agreements and contract. i have records of everything. If anyones going to win a case of this nature, i'll do it.

We're all human and make mistakes tho, im hoping this guy just had a bad day and desires mutual remedy for settlement.

I found a thread on another forum with this same guy, he was banned from there. My only concern when things go undelt with from an admin perspective, is it leaves a soar taste in the forum users mouth. I hope this doesn't end up effecting the reputation of this forum is all. *just a thought*

I think the suggestion of payment you make is good only most dont take work without deposit. Some do and i've never had a problem with them. some are nothing short of a pleasure to deal with.

On our forum we have a reviews section for people offering services. I think you REALLY need that here. So anyone offering services can be reviewed by people here. Like this

We don't allow discussion of disputes on the forum. The only thing that is allowed is a short description of what happened in the paid request thread. See Post #5.

Closing, since this thread has gone off track.
