Allowing Gun Transactions?
with the new president , my forum has got a new offtopic , GUNS AND AMMO its taking off like wild fire everyone is running out and buying AR-15's and getting hand guns and CCW permits , the economy is getting bad and criminals are growing ,
along with this comes people buying and selling guns on my site , I have searched the internet and from what i have seen im not responsible for the transaction if a felon was to get the weapon . what do you guys do ? we have been pulling the ads until we get a for sure answer on this , |

You should be okay if you JUST have a forum (like a classified section) which lets people buy/trade/sell firearms. Each seller (personal or business) is responsible for their own transaction and must ensure that the firearm is shipped to a vaild FFL, unless the transaction happens face-to-face (in person). This is actually part of the "gun show loophole" that Obama will probably try to close off. It's really no different than selling a shotgun in the local newspaper if it's face-to-face. Only firearms are regulated in this manner. Ammunition can generally be shipped to persons that are 18 years of age or older. Magazines, and other accessories are not regulated like this. Unfortunately, each state has different laws, so you will have to check with your state to see what your laws are. My personal opinion (and experience) says that you should at least have a sort of disclaimer on your site, stating that you are not responsible for transactions, sellers are responsible for ensuring they are within all ATF regulations, etc. You could also check forums like glocktalk.com and ar15.com and see what kind of disclaimers and actions they take to protect themselves, since they both have a buy/sell/trade forum for firearms and I have yet to hear of any negative action taken against them for any firearm related incidents. Its where the webmaster is not the server.
It makes no difference if your server is hosted in amsterdamn and you live in the united states You must follow the US law. And you probably won't be held responsible for transactions that occur on your site. Firearm's aren't supposed to be mailed between any two average Joe's, they need to go to a FFA dealer and some paper work before getting to whoever bought them, just a peice of information you might want your members to know. |
