FYI you are breaking Jelsofts EULA, by having warez discussion.

.LuTioN. 04-03-2004 03:04 AM

Thought it was just for linking files, and things of that sort and not just talking about the scene? Also, files we link to are freeware and demo.....

This isnt a dedicated warez forum... we are more of a gaming and general discussion site.

No he isn't. Having discussions about warez is completely legal. Jelsoft can not tell people what they can and can't talk about on 'customer' forums. as long as there is no linking of any sort then he is not breaking the license agreement.

Many times have i had discussions regarding warez. and priated software on my forums. Some people talked about how there against it, as others said they were with it.

Piracy, and Warez
We do not mind discussions about piracy or warez, as long as they are just that...discussions. Linking or giving information about any site that distributes illegal software, or warez, seeking help to circumvent any copyright laws, or encouraging software or media piracy is grounds for an immediate ban.

So we should shut them down now huh?

@.lution, Nice style man, love the colors (i like dark styles) and your icons are nice also (Icon Key) TIP: Make your header a link redirecting to the forums home page. Alot of people like clicking the header to go back.

Theirs no violation with the EULA discussing pirated software OR even having links to cracks per said software. Reason is because for obvously discussion that would break freedom of speech, and no agreement can undo constitutional rights.

As for the links to cracks - the courts have found that links to cracks are OKAY AS LONG AS they do not have links to the full software or give any means of accessing, downloading or getting said software without paying.

Thaks for the tip. I really don't know why I haven't done this already. There is a problem when I tried to do this. I have no clue how to work around this. When I aded the link, it makes this horrible purple border around my image. Take a look at the screenshot attached. I don't know if anyone can help me lose this border. I think it has something to do with me having my image resized?

Code:

<tr>
    <td width="469" height="137" align="left" valign="top"><img src="mystyle/myimage.jpg" width="785" height="137" alt="" /></td>
  </tr>

It seems to appear no matter where I place it.

Thanks for the tip though -D
Hopefully I can get this to work.

@[]\[]emesis

Thanks, that fixed it :)

**still wondering why everyone is talking about my site and warez... waiting for someone to point me to a link on my forum that breaks the EULA ;)

I just need feedback on my site, not a warez lecture =D

.LuTioN. 04-03-2004 03:53 PM

Thanks nzs for the kind words :)

nzs 04-03-2004 04:22 PM

The reason why its purple is because its a visited link. Check your style options to change it.

Logikos 04-03-2004 05:28 PM

Do this.

HTML Code:

<tr>
        <td width="469" height="137" align="left" valign="top"> <a href="$vboptions[forumhome].php?$session[sessionurl]"><img border="0" src="mystyle/myimage.jpg" width="785" height="137" alt="" /></a>
        </td>
</tr>

adding border="0" fixes that problem

Im not going to aruge but sortware piracy is breaking the EULA

Discussion on it, and about it is probaly ok, but once you start linking to warez sites, how to get warez and other such stuff then im fairly sure you would be breaking your agrement with Jelsoft.

Freedom of speach is only valid to a point, you think that in court you could get away with telling microsoft you were only taking about how to pirate there software and sell it to others?

The only way anyone would end up in court is if they started to sell there software. No company can bring you to court for having discussions reguarding priated software. I talked to my roommate today about priated software. You think im going to go to court if the company finds out that i talked to him about it. No.

Like NZS said, you can even go as far as linking members to game cracks, as long as you don't link them to a full priated download of the software.

nzs 04-03-2004 11:02 PM

Hold on boy DISCUSSION and LINKING TO CRACKS is completely legal. Courts have already said like I stated before that having cracks on your site for programs is NOT ILLEGAL

Now if people start saying hey heres a link to download the software then yes that would be illegal and considered piracy.

And yes, in a EULA you cannot force someone to use a software which is in its nature a community service "ie bulletin board" and say you cannot discuss this this this this and this. It is against freedom of speech and you cannot force people to not discuss certain topics. Now you can force people to not discuss your software code, or policies of your company but general communications that do not involve your company you cannot silence in any agreement.

Freedom is speech is just that. It doesn't have a start point or finish point. You have the right to say what you want, about anyone or anything you want at any time you want. If you use that freedom of speech to slander someone and what you say is proved to be false then you can get in trouble, but, you can still say anything you want.
