"THIEVES AMONG US" He Stole my Logo!
Ok, I've been here a little more than year, and I'm not asking for special treatment, just for crude justice... like everybody I've invested a lot of hours on a project, no mentioning the $$$ that my Mom can happily use.
So even I'm feeling disappointed to ask for help here since every effort to act together got ripped by many egos and interpretations. This Guy stole my Logo! as simple like that! no honor involved, no respect for the regular user... http://www.iogames.com/xxx/Stealth.gif http://www.xboxliveclans.com/introdu...post-here.html I bought my domain from a guy who owned for $200 usd based on the design of the logo, I sent to the Library of the Congress my copyright application and paid $60 dlls, I posted on my private blog to prove ownership with date: January 17, 2006, I created the Logo with my Photoshop Skills, I registered a Corporation in Nevada and make the logo be printed on the Seal, the Minutes and even on my checks, got the .PSDs, the .AIs and I'm paying some highly priced artist to brand all my site... :mad::mad::mad: So I'm asking you HONESTLY what can be done? [yes I will contact the guy and find him since we both live in CA] how can that behavior be corrected? |

first to save your the headache, he stole your logo but i'd imagine he took it because you're using it as avatar and he may not even realize its copyrighted work.
Secondly you never should have paid for a copyright application on an image. So many other ways to prove you own it. 3rd. You know who this member is here, why not attempt to PM him and solve this without all the noise. I can tell you know you're going to spend a small fortune and more then its worth trying to get a court room battle going. 4. IF all else fails, file a DMCA formal complaint with his host, There is no need to be hostile about it unless he refuses to remove it. You'll need to make sure your DMCA notice is in a standard DMCA notice format (search google for the DMCA template). |

Yes I did... his name *** Name removed, no posting of personal identification allowed ***. When your Copyright and someone infringe it, you have to send a 'Cease & Decease Letter' I've done it for friends. 2nd Marco, from person to person, Jelsoft is a LLC, I'm a Corp, you spent ALOT of hours working for free and this guy steals under our noses... So as I said there's values that must be protected, and it happened here. |
Is that his avatar or site logo? If it's an AV, who cares....

i do not care at all if your supposed logo is stolen and used somewhere else... this logo is not copyrighted for one reason, this is a generic sign. call Intel to not use it anymore on their computers, and you will have better results. i don't care if you are a corp, a naked chick or my mother, act like an adult. Lets go back to the basics, I know that the numbness of the monitor differs from the real life:
1. I was browsing threads to help where I could. 2. I found that copy of my logo by mistake: Mathematically talking tell me the odds. 3. I pointed with proof to the thief 4. everything evolved in 'should be-maybe' I can give hundreds of samples why Stealing is bad, but the point is, can you allow such behavior on your 'Watch'? P.S. I think I agree with another user that this thread is a bit premature if you haven't even contacted the guy. He most likely has no clue that you have a copyright on it and just thought it was cool to use.
I hate Cease and Desist letters. At least be nice when you write it. I've gotten some where the people are jerks and it doesn't make me feel like doing what they want. |
Thanks Lynne, I discovered the Logo last night when I was checking some code and answering some threads.
The point isn't if there's wrongdoing or not, THERE IS. and everybody here face tough problems on the daily basis, but once we sit at the computer reality got somehow distorted. We know I can win this one outside, my point is why Jelsoft software allows steal of private property, why the Rank Officers allow it, what is the protection criteria between copyright Artwork & Code, and how big must be the crime to apply norms and principles? P.S. Yes contacted the guy, got his info, but once again, 'it happened in your house' |
Dude relax, again its not jelsofts responsibility to monitor whats on everyones site. Jelfsoft doesn't know or care if you have a copyright for it, and i can guarantee that none of the staff really care either other then the fact this thread is taking up their space

If you consider posting in a internet forum about soemthing as trival and minute as someone using an your logo as an avatar has justice, then more power to you.
And If someone stole my house, and i knew who it was like you do, I'd contact them first ask for my stuff back, then i'd go with the following steps, NO where would i make a stop in the town square seeking revenge and justice from the masses for me. |
iogames, no offence, but I think that you are not right for 2 reasons.
I honestly don't know the legal details, so strictly legally speaking you might be 100% right. But common logically: 1- This is the design of the ON/OFF button, it's not new, and i don't understand how the symbol can be "owned". Although you have done some nice rendering and coloring. 2- Using your logo, or any logo, as an avatar and for non-profit purposes isn't much a big problem. The only reason you should be angry is if someone took your logo and is making profit out of it. Instead, you should feel flattered, that you did such a good work and people are actually using it as avatar. You know, on a funny note, I am a Phoenician descendant, and I don't know if you know, but the Phoenicians invented the alphabet, from which all latin, greek, cyrillic, arabic, hebrew alphabets came from. Can you imagine if I am granted royalties for every letter or derived letter used in the world, how much of a fortune I would make? :D |

The 'i' & 'o' embedded on the design plus the lettering level to 'substance' for registering... I'm adding some electronic circuit and waiting on the copyright office for note in a derivative work. There's an Electronic Convention here in L.A. and they have a sign who looks alike, even Staples launched service with a design alike...BUT NOT COPY & PASTE! If I start using logo from Moderators rest assured I will get slammed;and you say 100% right? Let's say I will open an account on his site, posting a 'Cease & Decease letter' I screenshot or download the page, he banned me or erase my post with vBulletin products, then we are talking abut liability! IO, being a victim of "code theft" myself, I can see where your frustration is coming from. However, you have suppled a screen shot of someone using your avatar.. as an avatar. It's really hard to take it seriously when it is just being used as an avatar. Had the guy been using it as his logo on his website, and claiming as his own work.. that's a different story.
My avatar is taken from a music video drawn by Todd McFarlane. I'm sure the music video is copy written, but I don't believe that anyone is going to care to track it down and make it be removed.. and technically, I'm not breaking any laws. I'm not claiming this avatar as my own work or anything. I guess my point is: Most avatars on forums are of copy written material. Not many people are going to take the time to design some custom image to use, and even when they do, someone might like it and want to use it as their avatar.. and legally, there is nothing wrong with it. |
my avatar would be useless to copy, because it is me on it -- hand made, designed by me... someone with the same look could use it, but he would be harassed with insults and menaces.. so i do not care.. lol

But the reaction will be different between musicians if they see you... I got 1 year here and he just got few months, so if not 'brain surgery' to reach a conclusion, I consciously posted here since under the law a printed or electronic publication counts towards registry. and even can quote the Coordinator here from few days ago: Quote:

Anyways.. you can't expect someone who sees your avatar to know that you created it. And in that case, as stated earlier, it would be best to contact the accused party and let them know that you don't approve of it. My post wasn't saying that it's not copy written, and Marco's quote is directed towards modifications.. so bringing that into this discussion was pretty much pointless. But if you still disagree and think that it needs to be handled legally, then all I have to say is, good luck getting a lawyer to take this case. |
