Isn't there some kind of law to protect you in this case? Since you obtained the domain before their trademark took effect ?

Would your domain be stricted by US laws if the server is not in US?

If you get booted off your host just move it here to China. Hosting costs are low and when the ebay lawyers come by they will be ignored. Or to Russia or India.

If you won ... where is the site?

kobescoresagain 06-02-2005 10:08 PM

Yes, just move it offshores. Possibly where the laws without a doubt o not restrict this. Ebay in my opinion is terrible. I ahve dealt iwth it before. They are the Walmart of the internet. i hate when people say, "I could get it on Ebay for this" Well, go their then.

ebay is a fine resource, I've never once had a problem with them.

Also I should warn you conducting illegal activity is still illegal, and since he lives in a country that respects copyrights, moving the site offshore isn't going to help much.

Ebay may be a fine resource, but that is not what I am talking about. They have ruined many different markets by driving prices down so much in certain areas. An example is the sports card market. Something that I am interested in. The majority of people into sports cards and such would blame ebay on putting many local shops out of business.

True his activity would still be illegal here, but they couldn't take the site down. Personally if you think the site is worth it, then contact a lawyer. See what your rights are.

An example is that there is a download website that hosts every song you can image and you only pay like $.03 a song. The owner lives in a country where it is illegal to not pay the artists and companies, but his site is still up because it is hosted where it isn't illegal.

This can only be seen as a good thing in my eyes, sports cards and memorabilia is ridiculously over-priced. I just don't get why people pay for so called rarities of a sports card? Who cares? From a consumer point of view, competition is always good :)

Sure couldn;t take the site down, but they could take him down, including personal assests ;)

Seems there's quite a few lawyers in here. Why aren't you guys out making money rather wasting your time in here?

:D

Thats bussiness, get over it, this is how it works. Ebay is in no way like wal-mart, wal-mart uses offshore labor working for peanuts to sell low price goods to the american public, they then stick one in a town and drive everyone else out of bussiness by lowering their prices. When they get rid of most of the bussiness they raise their prices again.

Ebay is people selling crap they don't need to people willing to buy it, think of it like the yard sale of the internet. Of course the people behind ebay get a little bit off the top, but at the end of the day they aren't really selling anything, they just provide you with the ability to sell something on the internet on a site a large number of people visit.
