I don't know about where you live but in the United States, where the majority of hosting companies are, the host has a right to review and reject any content on their servers at any time whether someone complains or not.
There is a principle in business that they can refuse to provide service for any reason. So if a host doesn't like black backgrounds, swearing or anything else, they can suspend your account and refuse to do service with you in the future. Most probably won't but that doesn't mean they can't.
