You should have access to 3.8.10 in the members area on vbulletin.com if you have access to 3.8.8

I believe you have to buy a v5 license, but it should give you access to the older versions. If you ask this on the vbulletin.com forums, you might get a more definitive answer.

not if their license expired prior to 3.8.10 being released.

You should be able to upgrade to just vB4Suite and then you will have access to 3.8.10.

It should not be possible to have a vB3 licence that expired after 3.8.8 but before 3.8.10.
We havent sold such licences since 2009, I think the last ones expired in 2013.

Isn't 3.8.10 still beta? Perhaps the OP is confused because it does not show up immediately in the download list and does not know he has to choose "more download options" from the dropdown, or whatever it reads exactly?
