In Europe, there is a new law since last month.
This law tels me to inform my members that there will be a cookie installed on their PC.

At the folowing website you can read this (English)
http://www.dataguidance.com/news.asp?id=1774

How can i make my forum so that members have to agree or disagree that there will be a cookie placed on their computer?
What does the cookie of my forum do exactly? (Have to inform members what it does)

Does that only apply if the host is from the same place

If the site is hosted in europe you have to.
Mine is hosted in the Netherlands, has a .nl extention, and has only members from the Netherlands and Belgium.

there is a mod to do this for you that you can install.
Search the mods sections and you will find it.

Has it occurred to anyone that the cookies for vBulletin are necessary to provide the communications and services provided by the forum?

Information must be provided to the user and consent must be obtained if cookies are placed for a reason other than for performance of the communication or is necessary to provide a requested service.

Ditto, not needed unless your settings cookies from something other than vb.

Isn't the cookie also responsible for tracking the user?
The what's new is set by a cookie I guess... This is not necessary for the forum to work...
In users online i can see where the member is...
In who's online I see that the member is online or not...
and so on..

Those things are concidered as privacy, and are included in the same law.
I can't find a translated website yet, but the Dutch version is here:
http://orangevalley.nl/cookiewet-update/

A translated piece of it is this:

IP addresses, cookies and tracking

It is important that the Dutch law the IP addresses as personal data are considered. This means that tracking systems and cookies that collect IP addresses probably fall under the Data Protection Act. Many web analytics tools and A / B - multivariate packages through technical changes to implement it. It remains advisable to do so also to consult a specialist.

Go here. This site has the cookie agreement forum as soon as you visit it, and it looks clean and nice.

Maybe you can ask them?
